Furniture and its Accessories ("Products") Terms and Conditions

These terms and conditions shall be applicable to & govern the purchase transaction of Maknoon Co. Furniture and its Accessories ("Product ") by and between the Customer ("customer'; "You" or"Your") and Maknoon Co. ("Maknoon; "Us" or"We")

1. Account and Registered User

  • In order to access certain functions of the Service, including the ability to order and purchase Products, you must register and create an account on [2d.com.kw] secured by a password (the "Account"). Any Account so created is personal and exclusive to you and is non-transferable to any third party.
  • If you register and create an Account, you are a "Registered User". To be a Registered User, you must be 21 years of age and must provide true and accurate information (including your name, date of birth, email address, credit/debit card details and other details) as requested during the Account creation process. Subject to applicable law, as a parent or guardian of a minor aged between 18 and 21, you may permit such minor to use your Account, on the basis that you remain fully liable for the use of the Account and for any use of the Service by such minor through your Account. We may carry out further checks to verify your age with a registered credit reference (or similar) agency and, if we are unable to verify you are over 21 years, we may cancel your Order.
  • By registering at and using on [ 2d.com.kw ], you warrant that the information provided by you in the course of the registration process is true and accurate and you undertake to ensure that such information is kept updated. You are responsible for maintaining the confidentiality of your Account and agree to accept responsibility for all activities that occur under your Account. In the event that you have any concerns regarding your Account or become aware of any misuse then you must inform us immediately (see Contact Us for more information and contact details).

2. Ordering and Payment

  • Customer shall order for the purchase of the product by making full payment. Before placing Order, it shall be Customer's responsibility to ensure that the property/ premises have adequate access including matching the decor, dimensions, doors, corridors, stairs and corners to ensure proper access to delivery and fitting of the product prior to placing the Order. Customer may contact Maknoon Co. for advice if needed. No exchange, replacement or refund will be provided in such cases.
  • Maknoon Co. may at its sole option and at any time, without any notice, announce seasonal sales or promotional offers. Customer shall not be eligible for any discount or to claim re-billing or offer for the Products purchased prior to the announcement for such seasonal sales or promotional offers.
  • Customer acknowledges that the discount/price may vary based on the various factors including market situations, locations, promotions and seasonal offers, etc.
  • Products purchased must be collected within 20 days from the date and time of billing/invoice. Maknoon Co. shall have the right to charge demurrage and expenses if delivery is delayed or failed due to any act attributable to Customer. In addition, if there is a delay in collecting or taking delivery of the Products purchased by the Customer, Maknoon Co. may at its sole option cancel the sales and resell the same product to any other customer in order to defray the costs or recovery the loses/expenses if any from the Customer. Customer agrees to pay the delivery charges for subsequent delivery, if any, costs for which shall solely be determined by Maknoon Co.
  • Upon written request from the Customer, Maknoon Co. may, at the sole discretion, allow storage of the Products at its warehouse, subject to payment of additional warehousing charges to be decided by Maknoon Co. from time to time. However, such storage of the Products shall not be beyond 30 days from the date of billing/invoice.
  • The prices and discounts (if any) displayed in the store shall be final. Any price, offers, discounts etc. quoted anywhere else shall not be applicable.
  • In the case of payments by cheque/ DD/Card (credit or debit), the product shall be delivered only upon realization of the amount.
  • Layaway Service may be provided by Maknoon Co. at its sole discretion and subject to the followings:
    • Customer make the full payment towards the purchase of the product
    • Layaway period shall not exceed the period of 20 days from the date of invoice or payment whichever is earlier.
    • Lay-away Service shall stand cancelled beyond aforesaid 20 days' period and Maknoon Co. reserve the right to dispose of the Products in the manner it may deem fit, without any notice or liability.
  • Products covered under warranty shall be governed by Terms and Conditions of the Warranty, upon production of valid Original Warranty Card duly signed and stamped.
  • Orders once confirmed shall not be cancelled or altered under any circumstances, whatsoever, except as provided herein.
  • Cash is to be presented to our authorized customer service representative for collection on the spot prior to receiving delivery of the Products ordered. Our customer service representative will also carry a mobile payment terminal for you to make payment by Card (KNet, Visa/Mastercard).
  • Upon receipt of full payment, the customer service representative will hand over the Products with the invoice and the delivery note.
  • It may be noted that we do not accept payments by cheque in place of cash or Card when using Payment on Delivery option.
  • To ensure prompt and timely delivery, the Customer will be contacted at least 30 minutes prior to delivery.
  • Ordered Products cannot be withheld by the Customer on credit. Payment for the Products ordered is to be made at delivery. It may be noted that the person taking delivery of the Products should be the Registered User who had ordered the Products or his/her authorized person, providing adequate proof of such authorization.
  • In the event where you are not at home or at the specified location for order delivery, the customer service representative will wait at the address mentioned for a grace period of one hour with your ordered Products. Inability to establish contact during that time will prompt him to depart, and a call will be made again later in the day. Should that fail, the Order will be returned for another attempt on the following day.
  • In case our customer service representatives are unable to reach the Customer within 24 hours of placing the Order; it will automatically be deemed as cancelled.
  • Payment on Delivery option is not available for all Products and Products covered under the Pre-Order category but is available for select products as can be seen on the Website during your purchase of Products.

3. Delivery

  • Where the purchase value or invoice value of the product is less than 100 KD. and/or the place of delivery is beyond the jurisdiction of City Municipality or Town Municipality of the respective Maknoon Co. Store, Customer shall pay the transportation and delivery charges as specified by Maknoon Co.
  • Delivery shall mean the delivery of the product at ground level up to the main entrance of the customer address provided in the invoice or at Maknoon Stores (depend on the product).
  • During the time of billing, delivery Date shall be communicated by sending an SMS to the registered mobile number mentioned on the invoice/bill.
  • Customer acknowledges that there shall not be any telecommunications regarding the delivery of the Product from Maknoon Co.
  • Where Customer desires to re-schedule the delivery date or communicate the change in delivery location, Customer may, intimate Maknoon Co. at least three business days prior to the date of delivery communicated vide SMS.
  • However, acceptance of such re-schedule request or change in delivery location shall be at the sole discretion of the Maknoon Co. They shall be subject to availability of the delivery slots and distance and the terms herein.
  • Customer shall provide the copy of the identity proof (state or central government-issued) and invoice/ bill at the time of taking delivery of the Products.
  • Maknoon Co. delivery team shall not dismantle, move or do any kind of modification to any existing furniture or other items at Customer's residence or delivery location.
  • Customer shall ensure that there are no hindrances/ obstacles from any person/authority, whosoever, at the time of delivery and Maknoon Co. team is allowed to access and use service elevators or other facilities in connection with the delivery of Products at Customer's delivery location.
  • Customer undertakes to inform Maknoon Co. about non-availability of elevator or any other factor including society/apartment rules, by-laws etc. that may cause hinder or causes obstacle in the delivery of the Products, prior purchasing the Product or billing/­ invoice and also agrees to pay such additional delivery and or labour charges as determined by Maknoon Co.
  • While all care shall be taken by Maknoon Co. in transporting the Products safely, however, Maknoon Co. does not take any responsibility or liability for any damage to the building or any structure at Customer's delivery location
  • The delivery of the product to customer location shall be subject force majeure events, normal transit wear and tear and act beyond the control of Maknoon Co. including traffic, breakdown of vehicle etc. and in such case Maknoon Co. shall inform the Customer and re-schedule the delivery as per availability of slot & date.
  • As per Maknoon Co. 's Policy, Customer shall not reward or gratify the Maknoon Co. 's delivery and assembling team.
  • Customer shall ensure that the mobile number given in the invoice is reachable for the Maknoon Co. delivery team to contact for delivery of the Products.
  • Customer shall make himself available to take the delivery of the Products on the scheduled delivery date. In case the Customer does not accept the delivery or is not available on the agreed date of delivery, subsequent delivery shall be on a chargeable basis and subject to the term herein. The charges will be as per the rate card informed by Maknoon Co.

4. Assembling

  • Assembling will be completed by Maknoon Co. subject to available fitment schedule. Simultaneously upon delivery of the Products, Customer shall inspect the Products for any manufacturing defects and acknowledge the receipt of the Products. Except as warranted, Maknoon Co. shall not be responsible for any damage to the Products upon receipt of customer acknowledgement.
  • Post Assembling, the Maknoon Co. team may help in clearing any debris like cartons and packaging material.
  • Upon completion of assembly and Assembling of the Products and before Maknoon Co. team departs from the delivery location, Customer shall check the defects or damage in the product and provide acknowledgement to Maknoon Co.

5. Exchange and Refund

  • Maknoon Co. may at its sole option exchange the Products, provided the same is returned within 30 days from the date of purchase/invoice, Customer submits the original invoice/receipt and is in the original packing, unused and saleable condition. Regard­ less the forgoing, Products that are unpacked and or installed /affixed shall not be exchanged once the same is sold. If Maknoon Co. agrees for an exchange of the product, then the credit note shall be issued deducting the delivery charges.
  • Payment shall not be refunded except in the case where Maknoon Co. is unable to repair or replace the defective Products.
  • Refunds (if any) shall be, either, made through cheque or in the form of credit note equivalent to the invoiced value of the Products, after deducting all offer value.
  • All refund shall be made through cheque or credit note will be issued within 30 days from the date of the confirmation by Maknoon Co.; or where the refund is in the form of the Credit note. No duplicate Credit Note will be issued, if the Original is lost or mutilated or expired.
  • Customer shall not be eligible for any exchange /refund for the Products purchased on 'as is where is' basis or store display Products.
  • Where applicable, refunds if any, shall be subject to agreement between the Customer and financer, if any.

6. Warranty Terms

  • Warranty for the Products shall be for a period of one year from the date of invoice and ONLY against manufacturing defects in the Products
  • Maknoon Co. reserves the right to inspect & determine the manufacturing defects in the Products. In case of manufacturing defects in the Products is affirmed, then Maknoon Co. may at its sole discretion, either repair or replace such defective Products. However, such repair or replacement shall be subject to the availability of the spares of the Products.
  • Customer acknowledges that repair or rectification of the product requires considerable time due to non-availability of spare parts, rectification slots of the workers, carpenters etc. The timelines for rectification shall be communicated in advance to the Consumer and only upon agreement of the Consumer, Maknoon Co. shall take up /proceed with the rectification process of the Products.
  • The duly filled and stamped warranty card along with the relevant invoice and date has to be produced in order to avail the warranty of the product.
  • Glass material /items in Products, display Products (last piece), Products purchased on 'as is where is' basis are not covered under warranty and shall not be returned, exchanged or replaced under any circumstance in case it is broken, stained, used or altered.
  • Warranty does not apply for
    • chrome-plated parts of the furniture
    • The product has a natural tendency of deterioration, e.g., foam or polyfill.
  • The decision of Maknoon Co. regarding the nature of the defect and applicability of warranty shall be final and binding.
  • The warranty shall not apply if the damage or loss to the product is caused due to factors like
    • natural wear and tear
    • improper Assembling by the Customer other than as provided in the manual
    • Improper or inadequate maintenance of the product
    • wrong handling of the product
    • any movement whatsoever from the initial location of Assembling or delivery
    • breakage of glass or the product
    • pest, termite & fungus infestation
    • modifications made to the product
    • any misuse or negligent usage as determined by Maknoon Co.
    • the Products subjected to humid conditions or exposed to direct sunlight
    • rusting and fading due to non-maintenance
    • Assembling done by non-Maknoon Co. Assembling team.
  • MAKNOON CO. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL LOSS OR DAMAG­ ES AND MAKNOON CO. 'S MAXIMUM LIABILITY FOR ANY DAMAGE OR LOSS ARISING OUT OF OR RELATED TO THE USE OF THE PROD­ UCT OR OTHERWISE SHALL BE LIMITED TO THE COST OF PRODUCT.
  • Customer shall not rely on any verbal representation made by any employees or agents of the Maknoon Co. relating to Products or warranty conditions.
  • Except as specified herein, Maknoon Co. does not make any other express or implied warranties and conditions of merchantability and fitness for a particular purpose.
  • Customer shall use the Products in accordance with the user /care instructions provided by Maknoon Co. or as displayed on [2d.com.kw ]. Maknoon Co. shall not be responsible for any loss/ damage, whatsoever or any personal injury caused to a customer or any other personal directly or indirectly due to usage or Assembling of the Products. Maknoon Co. shall not be responsible for any mishap occurring due to reasons attributable to the Customer at the time of delivery or Assembling of Product.
  • The repairs or rectification of the Products shall be subject to the availability of spare parts. Customer also agrees and acknowledges that during the replacement or repairs, the colour, texture and appearance of the spare part of the Product or Product may vary from each model of the product.
  • Upon completion of warranty, Maknoon Co. is not liable to or shall not undertake repairs or rectification work of the Products.
  • Customer agrees and acknowledges that the Products purchased by the Consumer at Maknoon Co. will be subjected to Terms & Conditions defined by the manufacturer. Any clarifications, refund, replacement, after-sales Service or Customer support or warranty or repair or any other issues relating to the Products will be rendered by Maknoon Co. to the Customer. 7. Instructions

  • Customer shall ensure that, while the delivery or assembling period customer himself/herself or someone duly authorized by Customer is available.
  • Customer shall ensure the safety of their members while assembling of the Products. Maknoon Co. shall not be responsible for any mishap or damage that occurs during Assembling of furniture.
  • Customer acknowledges that Assembling of Products may create noise and disturbance which cannot be avoided. Customer also acknowledges that the Assembling of Products requires a power supply to use the drills and other equipment which shall be provided by the Customer at their own cost.
  • Customer shall keep the place of assembling of the product clear from any or all obstacles. The Customer should ensure that all his belongings are taken care, and the place of Assembling is kept free and clear.
  • Customer shall not allow the delivery team of Maknoon Co. within its premises except for delivery/ repair of the Products.
  • Customer acknowledges that the Products may be unpacked for random quality check prior to delivery. In such cases, a pre-checked certification shall be pasted on the repacked Products.

8. Other Terms

  • Maknoon Co. shall not be liable for any failure of or delay in the performance of its obligation hereunder for the period that such failure or delay is due to causes beyond its reasonable control, including but not limited to acts of God, war, strikes or labour disputes, embargoes, government orders or any other force majeure event or acts beyond its control.
  • Both parties acknowledge that each of them is independent entities/person, and neither of them shall in any way, represent the other as its agent or principal.
  • These terms and conditions represent the entire current understanding between the parties and supersede all previous arrangements, understandings between the parties in respect of the subject stipulated herein.
  • Notwithstanding anything contrary herein, Maknoon Co. reserves the right to alter/ modify any terms and conditions at any point of time without any reason or any intimation whatsoever.
  • Customer shall not assign any of its obligations to any other party. No waiver of any right will be deemed effective unless it is made in writing and signed by both Parties.
  • Should any part of these terms or understanding between the parties is held to be invalid, illegal or unenforceable, or partly illegal or partly unenforceable, the legal and enforceable portion shall be enforced to the maximum extent possible.
  • The understanding between the parties shall be governed by the laws of Kuwait. Any dispute between parties shall be settled solely and exclusively by Kuwaiti courts.
